| CITY OF MEDFORD POLICY REGARDING DEDICATION OF LANDS FOR PUBLIC USE IN NEW SUBDIVISIONS | |||||||||||||||||||||||||
| 1) In all new subdivisions in the City of Medford the subdivider shall dedicate a portion of the property to be subdivided for public use. The property so dedicated shall be comprised of the following minimum percentages of the overall area in the subdivision: Zoned District Minimum Percentage to be Dedicated Residential 10% Commercial 10% Industrial 10% Other Zoning Districts 10% The dedicated land shall be comprised of one parcel unless otherwise agreed upon by the City of Medford. Such dedicated property shall be in addition to the property dedicated for streets, alleys, waterways, or other public ways. No areas may be dedicated as parks, playgrounds, or public lands until such areas have been approved for the purpose to which they are to be dedicated. The subdivider shall leave such dedicated land in a condition suitable to the City of Medford. The City may, in its sole discretion, exempt developments from all or parts of this policy if, in the opinion of the City Council, the open spaces presently provided for in the subdivision are adequate. 2) The City may require, in lieu of land dedication, a payment to the City by the subdivider of a sum equal to the percentage listed above of the market value of the land to be subdivided. The value of the land shall be determined by a current appraisal performed by an independent qualified appraiser. The cost of the appraisal shall be the sole responsibility of the subdivider. 3) Where a proposed subdivision includes property, in addition to the dedicated property set forth in Paragraph 1, that the city or School District desires to acquire for purposes of a proposed park, playground, school site, or other public site, such property shall be shown as reserved land on the preliminary plat to allow the City or School District the opportunity to consider and take action toward acquisition of such property by purchase or other means prior to approval of the final plat. |
